Terms and Conditions of Use

By making a booking through Goranga.com as an Online travel booking platform, you will enter into a binding contract with a Local DMC (Destination Management Company), Attraction Provider or a Local Tour Operator who will be solely responsible for providing the travel services which you choose, based on their separate terms and conditions. A “DMC or a Local Tour Operator” would be referred to as a ‘Supplier’ may be a supplier of travel services itself, or it might be an organiser of travel services based in a local country who sources tours, trips, attraction tickets, transport, etc. References to ‘travel services’ throughout these Terms of Use consist of any travel service provided to you (and any member of your party) by a Local DMC, Attraction Provider or Tour Operator or its sub-contractors, including, but not limited to tours, trips, voucher attractions, transport, etc.

About Your local DMC & Tour operator

Goranga.com acts as a Service Booking Platform for the Local DMC’s, Attraction Providers or Tour Operators and does not provide travel services itself. Goranga.com’s role is to select the best Local DMC, Attraction Provider or a Tour Operator for you to contract directly with, to provide a website and booking platform namely www.goranga.com which allows you to access travel services as provided by our Partner Local DMC’s, Attraction Providers & Tour Operators. It also provides a secure, easy way to pay such suppliers using credit or debit cards, and to financially protect all payments made through this platform.

Financial protection

When you make a booking via Goranga.com, your booking is financially protected in the event of a Local DMC, Attraction Provider or Tour Operator becoming insolvent. All the money paid to Goranga.com goes to a Trust Account which protects you financially in case a Local DMC, Attraction Provider or a Tour Operator featured on our Platform becomes insolvent. Under this policy, all bookings made through our Platform with our contracted suppliers would be financially protected. The Trust Account provides financial protection for any payments you make via the Platform only; it does not provide you with the cover for any accidents, injuries, losses etc. which may occur on your travel. We, therefore, strongly advise you to opt for suitable personal travel insurance policy providing cover for such occurrences for all members of your party (see clause 09 for further details).

Booking platform

This page (along with Privacy Policy & with any other documents referred to on it) explains to you the terms on which you (the user of the Platform and any members of your party, as may be relevant, depending on the context) may make use of the Platform, whether as a visitor to the Platform or a registered user, and the terms on which we will arrange for you to enter into a binding contract with Local DMC, Attraction Provider or Tour Operator who will be solely responsible for providing any travel services which you book (whether as the direct suppliers themselves, or as the tour operator organising your travel services using their sub-contracted suppliers). For clarification, if a Local DMC, Attraction Provider or Tour Operator is using sub-contracted suppliers to provide travel services to you, then the Local DMC, Attraction Provider or Tour Operator will still be responsible to you for the provision of those travel services, because the Local supplier has entered into the contract with you to provide those travel services, as Principal.

The key points in these Terms of Use are:

  • explaining how bookings for travel services are concluded and delivered by Local suppliers or their sub-contractors, including how payments for travel services are processed;
  • information on the protection of your money when you make payments through www.goranga.com;
  • confirmation of contractual arrangements with Local DMC, Attraction Provider or Tour Operator and recommendation that you take suitable personal travel insurance; and
  • details on how our Platform can be used by you to get access to travel services provided by Local DMC, Attraction Provider & Tour Operator.

Please read these Terms of Use carefully (including information on bookings as well as our general terms of use applicable to the Platform) before you start using the Platform. By using this Platform, you are providing your consent that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using the Platform any further. Any further use of the Website or any part of it means you have read and understood the Terms of Use and the Privacy Policy, and agree to be bound by all parts of the Terms of Use. The Platform is operated by Goranga Limited, a company registered in England and Wales under company number 10287115 whose registered office is at 223 Twickenham road, Isleworth, London TW7 6DH (“Goranga Ltd.”).

How Goranga bookings are made

Goranga.com acts as a Service Booking Platform for the Local DMCs, Attraction Providers & Tour Operators whose travel services are featured on the Platform. Goranga Ltd. makes it safe and easy for you to book by carefully selecting the Local DMCs, Attraction Providers & Tour Operators around the world for whom it acts as a booking platform (based on the experience, reputation, quality of service and reliability of the suppliers as researched by Goranga Ltd.), in order for you to contract directly with Local DMC, Attraction Provider & Tour Operator for the provisioning of travel services. As Goranga.com only acts as a service booking platform, the Local DMC, Attraction Provider or the Tour Operator will be fully responsible to you and all persons included in any booking you make, for all aspects of your booking. All contracts for provision of any travel services that you may purchase, are on the booking terms and conditions, as applicable to the relevant Local DMC, Attraction Provider or Tour Operator with whom you might contract, as notified to and accepted by you at the time of making a booking. Since we act as service booking platform for Local DMC, Attraction Provider or Tour Operator, Goranga.com accepts no responsibility or liability for any acts or omissions of the Local DMC, Attraction Provider or Tour Operator with whom you may contract for the services they provide. Furthermore, Goranga.com does a complete due diligence before signing up a DMC or a Tour Operator to be able to load and sell their products on the platform but it does not warrant or guarantee that the quality or standard of the travel services offered or sold on the Platform by the Local DMC, Attraction Provider or Tour Operator (for whom Goranga.com acts as service booking platform only) will be provided by the Local DMC, Attraction Provider or Tour Operator to any particular standard. Goranga.com will provide you with reasonable assistance in relation to any complaint you might have against a Local DMC, Attraction Provider or Tour Operator in accordance with clause 12 as stated below. You may wish to review any available comments and ratings made by previous customers of the Local DMC, Attraction Provider or Tour Operator which might be stated on our Platform. Should there be any concerns regarding any travel services purchased by you, these must be brought to immediate attention of the Local DMC, Attraction Provider or Tour Operator and the Goranga.com customer service team by you directly. Goranga.com provides the Platform for the purpose of allowing users to access travel services provided by Local DMCs, Attraction Providers or Tour Operators. You should not seek to contact Local DMC, Attraction Provider or Tour Operator directly outside this Platform when arranging a booking, otherwise this may affect Goranga Ltd.’s ability to track bookings made with the Local Travel Operator that have originated from the Platform. Doing so would also mean that you would not get any financial protection for travel arrangements booked outside of the Platform, in accordance with these Terms of Use. The process of making bookings with Local DMCs, Attraction Providers or Tour Operators for the provision of travel services is set out in detail on the Platform and summarised in these Terms of Use. All bookings are subject to the following terms, as well as the General Terms of Use as set out below:

1. Enquiries: You may make enquiries through the Platform about a travel service as featured on the Platform, for the provision of information relating to travel services provided by the Local Tour Operator. Please note that travel services may be withdrawn at any time prior to you receiving confirmation of your booking from the Local Tour Operator. All travel services sold through the Platform are not an offer directly by us to sell any services, but instead the Platform provides a mechanism for you to choose and purchase travel services from Local DMCs, Attraction Providers or Tour Operators, who are the sole providers of all and any travel services as described above. The Local DMCs, Attraction Providers or Tour Operators are free to accept or reject a proposed booking from you (or we may do so on their behalf) subject to a technical / weather or any other foreseen circumstances.

2. Making a booking: Once you are ready to book a specific travel service which is being hosted on our platform, you will be able to book the same by clicking the ‘Book Now’ button given against each tour. You will be then required to enter all relevant details requested during the booking process on the Platform and to accept our booking terms and conditions, prior to being asked for the payment of the travel services on the booking page. The Local Tour Operator’s booking terms and conditions will be subject to the laws and jurisdiction of the country in which the Local DMC, Attraction Provider or Tour Operator is based (unless stated otherwise), as detailed in the Local Tour Operator’s booking terms and conditions .

3. Authority: You confirm that you are at least 18 years old and have full legal authority to enter into any travel related arrangements with a Local DMC, Attraction Provider or Tour Operator through the Platform (on behalf of you and all those people included in your booking). You herewith also agree to be financially responsible for the use of the Platform including (but not limited to) being responsible for full payment of any bookings you make for yourself or any member of your party.

4. Local Tour Operator: Any bookings made through the Platform will be under direct control of the Local DMC, Attraction Provider or Tour Operator. Goranga.com shall not be responsible in any way to you or the Local DMC, Attraction Provider or Tour Operator under the contract entered into between you and the Local DMC, Attraction Provider or Tour Operator otherwise. The Local DMC, Attraction Provider or Tour Operator will be solely and fully responsible to you for all aspects of your booking and all travel services. If you have any specific requirements or needs then these should be communicated to the Local DMC, Attraction Provider or Tour Operator through the Platform whilst making the booking to ensure that your needs and requirements can be dealt with & provided for (if possible), prior to service date.

5. Confirmation: Once you have completed the booking on the Platform and made the payment against the booking (as requested by the Local DMC, Attraction Provider or Tour Operator at the time the booking and subject to the Local Tour Operator’s Booking terms and conditions) through the Platform, you shall receive a notification via platform detailing the receipt of payment & provisional confirmation. Your booking shall not be termed as confirmed until you have received a formal booking confirmation from the platform. Please check that all names, dates and timings are correct on receipt of all relevant documents and booking confirmations. If you notice any errors in your booking confirmation, please raise this immediately through the ‘Manage My Booking’ section on the platform. Any amendments that need to be made to the booking may incur additional charges (if the error was made by you) and are at the discretion of the relevant Local DMC, Attraction Provider or Tour Operator. The names as specified in the booking must be exactly the same as stated in the traveler’s passport. The booking information you supply will be passed on by us to the relevant Local DMC, Attraction Provider or Tour Operator or any other person whose involvement is necessary for the provision of your travel services. The information may therefore be provided to public authorities such as customs or immigration, if required by them, or as required by the law. This applies to any sensitive information that you may provide such as details of any disabilities, dietary or religious requirements. Certain information may also be passed on to security or credit checking companies. In making this booking, you agree that this information can be sent on to the relevant persons. 6. Payments: Goranga.com accepts payments from you on behalf of the Local DMC, Attraction Provider or Tour Operator. Goranga.com then passes this amount (minus relevant bank charges and our commission) to the Local DMC, Attraction Provider or Tour Operator, in accordance with our payment arrangements with Local Tour Operator. In accepting payments on behalf of the Local DMC, Attraction Provider or Tour Operator, Goranga.com is acting solely as Service Booking Platform and is not responsible for any aspect of providing the travel services (that are provided solely by the Local DMC, Attraction Provider or Tour Operator or its authorized sub-contractors), or for any aspect of the contract between you and the Local Tour Operator or for the acts or any omissions of the Local Tour Operator. Goranga.com reserves the right to notify the Local DMC, Attraction Provider or Tour Operator if required payments have not been received by us on the specified payment dates. Goranga.com shall not be responsible for any action a Local DMC, Attraction Provider or Tour Operator may take in connection with your booking. The Platform also provides payment processing system for you to make secure payments for a booking made by you on the platform. Goranga.com’s responsibility to you is limited to facilitating the booking with the Local DMC, Attraction Provider or Tour Operator through the Platform. Goranga.com does not accept responsibility for any information about the travel services that is provided on the Platform in good faith, or for any use made by you of the information provided on the Platform. However, in the unlikely event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to exact cost of your booking (minus relevant bank charges), if any (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude any liability that we may have for death or personal injury, as caused by our negligence or that of our employees whilst acting in the course of their employment, or for fraud or fraudulent misrepresentation.

7. Booking Conditions and Personal Travel Insurance:

  • You are advised to opt for a suitable travel insurance for all aspects of your holiday and travel services (and for all members of your party) for which you contract with Local DMC, Attraction Provider or Tour Operator, including (but not limited to) death, personal injury or any other loss. When you make a booking using Goranga.com’s platform, this booking will be directly made with a Local DMC, Attraction Provider or a Tour Operator and you will be under a contract on the basis of Goranga.com’s Terms and Conditions plus Booking Terms & Conditions of Local Tour Operator. The Local DMC, Attraction Provider or Tour Operator may not have sufficient or any liability insurance, hence you are strongly advised to purchase suitable travel insurance of your own.
  • Bookings made via Goranga.com’s Platform are financially protected, as described in detail below. Our supplier failure insurance policy means that the full amount of any money paid by you for any booking made on the Platform is protected in the event of insolvency of either Goranga.com or of the Local Tour Operator. However, as mentioned before, Goranga.com supplier failure insurance policy covers financial protection of any money you pay for a booking on the Platform, but does NOT cover any other liability in connection with your holiday and travel services.
  • Goranga.com supplier failure insurance policy does NOT apply to any bookings made outside of the Goranga.com’s Platform. You are advised that if you were to book directly outside of the Goranga.com’s Platform; Local DMC, Attraction Provider or Tour Operator themselves may not provide any protection for money paid upfront for the provision of travel services and they may not be bonded or have any other similar financial protection schemes in place.

8. Financial Protection: As mentioned above; when you make a booking via Goranga.com’s platform, your booking is financially protected in the event of the Local DMC, Attraction Provider or Tour Operator becoming insolvent.

  • In addition and as mentioned above, Goranga has employed Trust My Travel as a trusted Payment Gateway for all the Travel Services that are booked on the platform.This means Goranga.com is fully protected in the event of the financial failure of a Local Tour Operator. This means that should a Local DMC, Attraction Provider or Tour Operator become insolvent, Goranga.com will either make every reasonable effort for a similar trip to be provided by an alternative Local DMC, Attraction Provider or Tour Operator or should that not be possible, refund any monies paid by you via the Platform. Please be aware that in the event of an alternative Local DMC, Attraction Provider or Tour Operator who shall be arranging your trip, these Terms of Use will still apply to your Booking in full, together with the additional Terms and Conditions of Local Tour Operator relating to the provision of your travel services.
  • Notwithstanding the financial protection in place as detailed above, we strongly advise you to take your own suitable personal travel insurance covering all members of your party to cover (but not limited to) personal injury, death and any other loss, for the reasons set out above.
  • Goranga.com does not books flights for you, therefore any financial protection offered (as described above) is only in respect of the local travel services booked with the Local DMC, Attraction Provider or Tour Operator via the Platform.
  • Goranga.com undertakes to maintain high standards of service to you. Any dispute that may arise in connection with your holiday / travel services should be raised with the Local DMC, Attraction Provider or Tour Operator as per the clause 12 stated below.

9. Flights: You will be solely responsible for booking all elements of travel services which you and your party may require. The Platform does not offer any flights and you cannot book flights directly through the Platform. Furthermore, Goranga.com does not act as an agent for any airlines. The Platform may have some links established to flight aggregator sites for potential flights, however Goranga.com is not responsible in any way for the provision of any flights or other travel services and you are entirely responsible for ensuring that any flights you purchase are suitable for the travel services that you may purchase from Local DMC, Attraction Provider or Tour Operator through the Platform, including (but not limited to) the correct timings for arrival/departure in the country where you are travelling to/from, as well as any connecting flights and/or transfers required in order for you to benefit from the travel services you purchase. You are recommended to ensure that any flights you purchase are from reputed companies and that you have suitable insurances to cover any flights you purchase, as well as any relevant financial protection required to safeguard against failure of an airline to provide the flight(s).

10. Cancellation/Amendment: If you need to cancel or amend a confirmed booking; cancellation and/or amendments charges may be payable to a Local DMC, Attraction Provider or Tour Operator (which may be upto 100% of the cost of the travel services booked with a Local DMC, Attraction Provider or Tour Operator and these may vary depending upon when this occurs). The amount of such charges will depend on the Local Tour Operator’s Booking Terms and Conditions and you should review these prior to booking a service and ensure that you have any additional insurance required to cover such events and charges that may be applicable to your booking, amendment or cancellation of the same with the Local Tour Operator.

11. Disputes: In the event of any dispute between you and a Local DMC, Attraction Provider or Tour Operator; this must be dealt with between you and the Local DMC, Attraction Provider or Tour Operator as your contract is with them. If you have a problem whilst you are abroad relating to the travel services, you should bring this to the immediate attention of the Local DMC, Attraction Provider or Tour Operator in order to give them the opportunity to investigate and rectify your complaint. If you fail to follow this procedure, there will be less feasibility to investigate and rectify a problem. If you wish to make a complaint upon your return home, then please contact Goranga.com and the Local DMC, Attraction Provider or Tour Operator directly within 15 days of completion of the specific travel service. Goranga.com will provide you with reasonable assistance in relation to communicating and seeking measures to resolve any complaint that you may have against the Local DMC, Attraction Provider or Tour Operator for the provision of its travel services if you wish (including forwarding correspondence and providing the Platform for any continued communication between you and a Local Tour Operator), however; in no case, Goranga.com shall be liable to you in respect of any payments or any other matters in connection with your complaint. Any amounts of compensation, refunds or other monies to which you may be entitled shall be governed solely by the Local Tour Operator’s own Booking Terms and Conditions.

12. Refunds: Where payment has been made using a debit/credit card, any refund will automatically be processed to the original credit/debit card account that was used to pay for the booking and no other methods of refund shall be possible. In all other cases, the payments shall be made in the same mode and by the same branch where originally the funds were received. You are eligible to apply for a refund within a maximum period of 15 days after a travel service has ended. No refund request will be entertained after the aforesaid period. Refunds may take several working days to reflect in your bank account depending upon your bank’s policies.

13. Passport, Visa, Medical, Health, Security and Safety matters prior to travelling: Any specific passport and visa requirements for you and all members of your party, or any other immigration requirements are your responsibility and you are required to confirm these directly with the relevant Embassies and/or Consulates. Neither, we nor the Local DMC, Attraction Provider or Tour Operator accepts any liability in case you are refused entry onto a flight or into any country because of the non-compliance with any passport, visa or immigration requirements. Most countries now require passports to be valid for at least 6 months after your return date and to have more than one blank page in them. As visa and health requirements are subject to change without notice, we would recommend you to kindly verify the same with appropriate consulate prior to departure. You should also check with your own doctor for your specific circumstances and all health and vaccination requirements for your trip and separately with appropriate government agencies (such as the U.K. Foreign Office) about the security and personal safety situation in the destination to which you intend to travel.

14. General Terms:

  • We reserve the right to make any alterations / modifications to above stated policies at any time by stating an ‘UPDATE’ Subheading on this Page. You are expected to check this page from time to time to take notice of any changes that we make, as they are binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provision or notices published elsewhere on the Platform. By using this Platform you accept that you are bound by the terms and conditions in force at that time and displayed on this page.
  • If any part of these Terms of Use or any document referred to herein is illegal or unenforceable, such portion(s) shall be excluded from these Terms of Use and any relevant document to the minimum extent required and the balance of these Terms of Use and any relevant document shall remain in full force and effect and enforceable.
  • These Terms of Use and any documents or policies referred to herein shall govern the entire relationship between the parties to the exclusion of any other terms.
  • It is not the intention of the parties to confer any rights on any third parties by virtue of these Terms of Use and accordingly the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms of Use.
  • These Terms of Use and any disputes that may arise between you and Goranga.com will be governed by the Laws of England and Wales and the jurisdiction of the English courts.

Website use

1. Access to the Platform is permitted on a temporary basis and Goranga.com reserves the right to withdraw or amend the service provided on the Platform without notice. Goranga.com shall not be liable, if, for any reason the Platform is not available at any time or for any period. From time to time, Goranga.com may restrict access to some parts of the Platform, or the entire Platform, if required. Goranga.com aims to update the Platform regularly and may change the content at any time. Goranga.com may therefore have to suspend access to the Platform, or close it if necessary. Any of the material (including pricing and details of travel arrangements) on the Platform may be out of date or incorrect at any given time and Goranga.com is under no obligation to update such material, however will use all reasonable endeavors to correct errors or omissions as quickly as practicable after being notified of the same.

2. If you choose, or you are provided with, a user identification code/name, password or any other piece of information as part of our security procedures, it is your duty to treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any provision of these Terms of Use.

3. Commentary and other materials posted on the Platform are done so using all reasonable skill and care; however, they are based on our opinion and are not intended to and do not amount to advice. Goranga.com disclaims all liability and responsibility arising from any reliance placed on such materials by any visitor to the Platform, or by anyone who may be informed of any of its contents. If & where we do provide any interactive services, we will provide clear information to you about the kind of service offered, if it is moderated and how, and will use reasonable endeavors to assess any possible risks for users when using the interactive service. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on the Platform and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards set out in these Terms of Use. Any contributions made to our interactive services must be accurate and genuine and comply with all applicable laws and regulations and our Terms of Use detailed herein.

4. You are responsible for making all arrangements necessary for you to have access to the Platform and for ensuring that all persons who access the Platform through your internet connection are aware of these terms and that they comply with them.

5. Goranga.com shall not be liable for and accepts no responsibility for any information presented by a third party (including Local DMC, Attraction Provider or Tour Operator) including, but not limited to, pricing, liability in connection with any bookings and cancellations made directly with a third party, or any other transactions between you and a third party, and the performance of the contract entered into between you and the third party or any circumstances that may arise during your trip.

6. All tours, trips and travel arrangements shown on the Platform are subject to availability and you must always check the availability on our platform prior to booking. You may book tours, trips or other travel services with a Local DMC, Attraction Provider or Tour Operator through the Platform.

7. Any links provided on the Platform to other Platforms are not intended to provide an endorsement by Goranga.com and Goranga.com will have no liability or responsibility for the content of this or those Platforms whatsoever. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link to this Platform in such a way so as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any Platform which is not owned by you. Our Platform must not be framed on any other Platform, nor may you create a link to any part of our Platform other than the homepage. We reserve the right to withdraw linking permission without notice. The Platform from which you are linking must comply in all respects with the content standards set out above.

8. Whenever you use a feature of the Platform that allows you to upload material to the Platform, or make contact with others through the Platform, you must comply with the following content standards, in particular you must ensure: you do not use the Platform in a way that breaches any applicable local, national or international law or regulation, or in a way that is unlawful or fraudulent, or has an unlawful or fraudulent purpose or effect;

a. the Platform is not used for the purpose of harming or attempting to harm others (particularly minors) in any way;

b. you must not use the Platform to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;

c. there is no access obtained (without our authority), and no interference with, damage or disruption to any part of the Platform, any equipment or network on which our Platform is stored, any software used in the provision of the Platform or any equipment or network or software owned or used by any third party; and

d. you do not use the Platform to gain a commercial advantage to the detriment of Goranga.com. You warrant that any contribution made and/or material uploaded complies with these standards and you agree to indemnify us for any breach of that warranty.

9. Goranga.com cannot guarantee that the Platform is free from infection by viruses or anything else that has contaminating or destructive properties. You must not misuse the Platform by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform.

10. Any destination / attraction / tour / travel-guide information on this Platform written or provided by Goranga.com is purely for the purpose of information. Goranga.com endeavors to ensure that such information is accurate and requests that such information as received from Local DMC, Attraction Provider or Tour Operator is accurate, however Goranga.com provides no guarantee that such information is 100% true. This information does not forms a part of your agreement with any third party (including Local DMC, Attraction Provider or Tour Operator) and is provided solely as an additional background content. Goranga.com shall not be held liable in any way whatsoever for any inaccuracy, misunderstanding or expectation drawn from this content.

11. All rights in the Platform, including copyright, the content and design of the Platform, is owned by Goranga.com or used under license from third party owners. Any use of this Platform or its contents, including copyright or storing it or them in whole or part, other than for your personal or non-commercial use is prohibited without the written permission of Goranga.com. You are prohibited from copying, modifying, transmitting, distributing, selling, displaying, licensing or reproducing any content including images and other media on this Platform for any commercial purpose. You must also not change the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. If you print off, copy or download any part of the Platform in breach of these Terms of Use, your right to use the Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

12.
